Which of your data do we process? And for what purposes?

We process the data you have sent us in connection with your application in order to check your suitability for the position (or other open positions in our companies, if applicable) and to carry out the application process. With your consent, we will keep your application in our applicant pool so that we can contact you at a later date to fill another position, if necessary.

We obtain the data from these sources

We process the data you have sent us in connection with your application in order to assess your suitability for the position (or other open positions in our companies, if applicable) and to carry out the application process. You can send your application to us in different ways: by email to kadry@indmont.com, by phone +48 726 605 300 / +48 601 820 071 or via our application form on our website indmont.eu. Regardless of the way you send us your application, we will always process your data in the same way.

On what legal basis is that based?

The legal basis for the processing of your personal data in this application procedure is primarily Section 26 BDSG. According to this, the processing of data required in connection with the decision on the establishment of an employment relationship is permissible.

Should the data be required for legal prosecution after the application process has been completed, data processing may be carried out on the basis of the requirements of Art. 6 DSGVO, in particular to safeguard legitimate interests pursuant to Art. 6 (1) Uabs. 1 lit. f DSGVO. Our interest then consists in the assertion or defence of claims.

We store your applicant data in our applicant pool exclusively with your consent in accordance with Art. 6 Para. 1 Uabs. 1 lit. a DSGVO.

How long will the data be stored?

Data of applicants will be deleted after 6 months in case of rejection.

In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There, the data will be deleted after two years.

If you are awarded a position during the application process, your application data will be transferred to our personnel information system or to your personnel file.

If you have given us your consent to include you in our applicant pool, this will be irrevocably deleted after two years at the latest.

Who gets my data?

Your application data will be processed by our human resources department. Suitable applications are forwarded to the department managers for the respective open position. The further procedure is then coordinated. In principle, only those persons in the company have access to your data who need this for the proper course of our application procedure.

When selecting applicants, we are supported by an employment agency. We have concluded a so-called order processing contract with this provider, which ensures that the data processing is carried out in a permissible manner. Your data will be processed there exclusively for application purposes at IndMont and will not be used for any other purposes.

We use a specialised software provider for the application process. This provider acts as a service provider for us and may also receive knowledge of your personal data in connection with the maintenance and care of the systems. We have concluded a so-called order processing agreement with this provider, which ensures that the data processing is carried out in a permissible manner.

How can I be included in the applicant pool?

If we do not make you a job offer, you have the option of being included in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 Para. 1 Uabs. 1 lit. a DSGVO). If you have applied online using our application form, you will be asked for your consent when submitting your application. Otherwise, if you are interested, we will ask for your consent either by e-mail or by letter, which you can grant us informally with a reply.

Giving consent is voluntary and is not related to the current application process. You can revoke your consent at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

Where is the data processed?

The data is processed exclusively in data centres in the EU.

What rights do I have?

Under the conditions of the statutory provisions of the General Data Protection Regulation (GDPR), you have the following rights as a data subject:

  • Information pursuant to Art. 15 DSGVO on the data stored about you in the form of meaningful information on the details of the processing as well as a copy of your data;
  • Correction according to Art. 16 DSGVO of incorrect or incomplete data stored by us;
  • Deletion pursuant to Art. 17 DSGVO of the data stored by us, insofar as the processing is not necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • Restriction of processing pursuant to Art. 18 DSGVO, insofar as the accuracy of the data is disputed, the processing is unlawful, we no longer require the data and you object to their deletion because you require them for the assertion, exercise or defence of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO.
  • Data portability pursuant to Art. 20 DSGVO, insofar as you have provided us with personal data within the scope of consent pursuant to Art. 6 para. 1 subpara. 1 lit. a DSGVO or on the basis of a contract pursuant to Art. 6 para. 1 subpara. 1 lit. b DSGVO and these have been processed by us with the aid of automated procedures. You will receive your data in a structured, common and machine-readable format or we will transfer the data directly to another responsible party, insofar as this is technically feasible.
  • Objection according to Art. 21 DSGVO against the processing of your personal data, insofar as this is carried out on the basis of Art. 6 para. 1 subpara. 1 lit. e, f DSGVO and there are reasons for this which arise from your particular situation or the objection is directed against direct advertising. The right to object does not exist if overriding compelling legitimate grounds for the processing can be demonstrated or the processing is carried out for the assertion, exercise or defence of legal claims. Where the right to object does not exist for individual processing operations, this is indicated there.
  • Revocation pursuant to Art. 7 (3) DSGVO of your consent with effect for the future.
  • Complain to a supervisory authority pursuant to Art. 77 DSGVO if you believe that the processing of your personal data violates the DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence, your place of work or our company headquarters.

Amendment of this data protection notice

We revise this data protection notice in the event of changes to our application process or other occasions that make this necessary. You can always find the current version here.
